United States District Court gives green light to RICO lawsuit, sets trial date
On March 7, 2005, U.S. District Court Judge José A. Fusté ruled that José Sanchez, et al., v. Triple-S, et al., a RICO lawsuit against health care insurer Triple-S Inc., filed in the U.S. District Court for the District of Puerto Rico, will proceed. Noting the gargantuan size of the classes, the court held that the Plaintiffs have properly pled racketeering conduct, including the RICO elements of enterprise and pattern. In a subsequent order, the court ruled that plaintiffs sufficiently pled allegations of mail and wire fraud as a series of predicate acts against defendant MC-21, a Triple-S subsidiary and fiscal intermediary.
The court has also entered a scheduling order and set a trial date for Nov. 6, 2007. Charlestons Hulsey Litigation Group partners Paul Hulsey and Cherie Durand are lead counsel in this class action representing more than 9,000 Puerto Rican citizens.

Dunes Properties works to reclaim sand-starved beaches
With a busy 2005 hurricane season predicted and the possibility of additional damage to sand-starved beaches looming, Dunes Properties is leading an all-volunteer beach preservation effort by hosting the second annual Doin the Dunes! on Saturday, May 7, 2005, at the Isle of Palms shoreline from 51st to 57th Avenue.
From 9 a.m. to noon, volunteers will install 500 feet of sand fencing and plant 3,000 sea oats to encourage the formation of new sand dunes. After a complimentary lunch, volunteers will enjoy sea kayaking and seining for treasures from the sea as part of the activities offered by event co-sponsors from noon to 3 p.m.
Beach erosion continues to be a significant problem for Charleston-area beaches. With four hurricanes hitting the state, the 2004 season was one of the worst years for South Carolina beaches since 1989, the year of the catastrophic Hurricane Hugo, according to officials from the South Carolina Department of Health and Environmental Control.
To encourage participants and spectators to join the effort, Dunes Properties is offering a 20 percent discount on beach rentals during that weekend to those who mention Doin the Dunes! when making reservations. Savings could be as much as $100 to $120 for a two-night stay at an oceanfront condominium with rates from $500 to $600. For reservations, call toll free at 888-The Beach (843-2322). The discounts, as well as free ball caps and beach coolers, are also available to spectators who mention Doin the Dunes! when calling for reservations. The Commonwealth Insurance Group announces partnership
The Commonwealth Insurance Group announced a partnership with Wellspring Healthcare Inc. Under the terms of the agreement, Commonwealth will use Wellsprings programs to proactively assist businesses in implementing wellness and prevention programs, designed to help reduce medical and workers compensation costs.
Insurance agents are increasingly looking for opportunities to assist employers beyond the sale of insurance, says Todd Tyler, Commonwealths president. Our relationship with Wellspring allows us to help our clients combat rising insurance costs through prevention rather than by reducing benefits or shifting costs to the employee.
Wellspring programming includes five essential elements: assessment, intervention, education, access and program design. Additionally, Wellspring concentrates on the entire person by including complementary, face-to-face health coaching services to address behavioral and lifestyle changes while incorporating a comprehensive Employee Assistance Program to address the behavioral, emotional and psychological factors that affect a persons readiness for change.
